How long do personal injury claims take?

It is impossible to estimate how long any particular claim will take. The time the your claim will take depends upon a number of factors. We are unable to accept or offer settlement until your injuries have ‘stabilised’ owing to the fact that we are not able to gauge whether or not they will deteriorate or improve in the long term.

To that end, it would be unfair for all parties concerned to settle if your injuries have not stabilized as you may be missing out on due compensation and visa versa.

Once your injuries have stabilised you will be assessed by a doctor who will provide a degree of permanent impairment. Once this is done it may be necessary for you to be assessed by a doctor retained by the defendants. Following this, a settlement conference will be scheduled and hopefully a settlement will be resolved.

The length of claims are also determined by the legal process that all claims must take (explained in detail elsewhere on this site) and sometimes the attitude of the defendant insurer or solicitor towards a particular claim.
